Debt Resolution Explained
Because everyone has unique goals and circumstances, we know bankruptcy isn’t always the best option. Fortunately, there are also non‑bankruptcy debt resolution methods available, such as Debt Consolidation and Debt Settlement. Both can be useful ways to reduce, restructure, or eliminate debt while easing the stress and harassment caused by debt collectors.
Debt Resolution versus Bankruptcy
On the surface, Debt Consolidation and Debt Settlement may look similar to bankruptcy because they often involve reduction, negotiation or modified repayment of debts owed to creditors, with the ultimate goal of eliminating certain debts. However, there are important differences between these methods and bankruptcy, including:
- No legal framework: Unlike bankruptcy, non-bankruptcy debt relief options are not governed by a formal system of laws.
- Voluntary participation: Outside of bankruptcy, creditors are free to accept or refuse participation. This means some debts may be resolved while other debts remain.
- Less certainty: Because bankruptcy requires creditors to comply with Court orders, it provides binding legal relief. Non-bankruptcy debt relief options, by contrast, offer less assurance of reaching a complete debt resolution.
While non‑bankruptcy alternatives can offer some relief, their ability to provide lasting or complete debt resolution is often limited and less certain. Whether these options are the right fit for you depends on your overall financial situation, your creditors’ willingness to cooperate, and your long‑term financial goals.
